Welcome to marieladelapaz.com (the “Site”), operated by Mariela de la Paz (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of the Site and any purchase you make through it. By visiting the Site or placing an order, you agree to these Terms. Please read them carefully.

1. About Our Store

We sell original oil paintings, limited-edition prints, and print-on-demand merchandise (canvas wraps, paper prints, metal prints, mugs, tote bags, prayer flags, greeting cards, and stickers) featuring original artwork by Mariela de la Paz. Some products are fulfilled directly by us; others are produced and shipped by third-party print-on-demand partners on our behalf (see Section 6).

2. Products and Pricing

Original oil paintings are one-of-a-kind pieces. Once sold, that exact piece is no longer available.

Prices for all products are listed in U.S. dollars and are subject to change without notice. The price charged is the price displayed at the time your order is placed.

We make every effort to accurately represent our artwork through photography, but slight variations in color, texture, and finish may occur between the digital image and the physical piece, particularly with hand-painted originals.

3. Payment

We accept the payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method provided.

4. Shipping

Shipping is included in the price of all prints and merchandise. There is no separate shipping charge at checkout for these items.

Print and merchandise orders ship within the continental United States, Alaska, and Hawaii. Tracking information is emailed to you once your order ships.

Original oil paintings are arranged directly with the artist. Because originals vary widely in size and value, delivery, crating, and any associated costs are discussed individually before purchase. Please contact us if you are interested in an original.

We do not currently offer international checkout. If you are outside the United States and wish to purchase a piece, please contact us directly and we will make arrangements where possible.

5. Returns, Exchanges, and Refunds

All sales are final. We do not accept returns or exchanges for change of mind.

If your order arrives damaged, please keep all original packaging and contact us with your order number so we can make it right.

Approved refunds are processed within 7–10 business days.

If you need to cancel an order, contact us as soon as possible — because many items begin production or shipping quickly, we cannot guarantee a cancellation will be possible once an order is placed.

6. Print-on-Demand Fulfillment

Certain products on this Site are produced and shipped by third-party print-on-demand partners. While we select our partners carefully and review product quality, we do not directly control their production processes. Minor variations in color, sizing, and material between print-on-demand batches may occur. If you receive a print-on-demand item that is defective or damaged, follow the process in Section 5 and we will work with our partner to resolve it.

7. Intellectual Property

All artwork, images, designs, and content on this Site are the original creation of Mariela de la Paz and are protected by copyright law. Purchasing a physical product (original, print, or merchandise item) does not transfer any copyright, reproduction rights, or license to use the artwork beyond your personal use of the physical item you purchased.

You may not reproduce, distribute, publicly display, create derivative works from, or use any artwork or image from this Site for commercial purposes without prior written permission from Mariela de la Paz.

8. Content Disclaimer

The artwork on this Site draws on themes of indigenous spiritual traditions, plant medicine ceremony, and personal visionary experience, presented as artistic and cultural expression. Nothing on this Site constitutes medical, legal, or health advice, nor an endorsement or instruction regarding the use of any substance, legal or otherwise. Viewers seeking guidance on health, spiritual practice, or legal questions related to these themes should consult a qualified professional.

9. Newsletter

You may opt in to receive our newsletter via Mailchimp. You can unsubscribe at any time using the link included in every email we send. See our Privacy Policy for how we handle information collected through the newsletter signup.

10. Website Use

You agree to use this Site only for lawful purposes. You may not attempt to disrupt the Site, scrape or copy its content for commercial use, or misrepresent your identity when placing an order.

To the fullest extent permitted by law, Mariela de la Paz shall not be liable for any indirect, incidental, or consequential damages arising from your use of this Site or your purchase of any product, beyond the purchase price of the product in question.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
